 If the Supreme Court announces a controversial ruling on a case brought before that body, you can count on Justice Antonin Scalia to consistently be on the wrong side of history.  He was wrong about Gore v Bush, he was wrong about Citizens United, and in the past couple of days he's been wrong on affirmative action and the repeal of vital sections of the Voting Rights Act, and yesterday he had a shit-fit of a dissent over the Court's decision to invalidate the Defense of Marriage Act in favor of gay marriage.

Trevon Martin update: Manslaughter for Zimmerman? Quite possible

The other evidence that came out today is the testimony of the police officer who took Zimmerman into custody.  That officer testified that Zimmerman’s jacket was wet on the back, and did have grass on it.  Obviously those facts are not apparent from the photos taken in the police station, but would support Zimmerman’s story.  I would also not that Mr. O’Mara did more of the cross examination of the witnesses today, and he was much more effective than Mr. West.
Thus after only a week of testimony I predict there will be a guilty verdict but not for Murder in the 2^nd but instead manslaughter.

Owning a firearm is a massive responsibility. It is important for firearm owners to know all the laws before they even think about purchasing one, much less carry one in public. The responsible ones NEVER want to be in a situation where they must use a firearm. It’s a last resort. It’s life and death at that point. There are many serious consequences that may result if someone ever pulls the trigger.
It sure seems like Zimmerman is not one of those responsible firearm owners. The very fact that he got out of his car to engage another person while carrying a firearm is proof of that.
Normal people – and well trained responsible firearms owners – get the police involved first if they can.

Stealing the Vote! How have things improved in Shelby County? A view from inside.

But what about those pesky justice issues? In that regard, Shelby County is a cesspool. The county seat is in a little hellhole called Columbiana, and when you take one step into the city limits, it's as if you've entered a time warp and gone back to . . . oh, about 1912.

Experience has taught me that almost all of Shelby County's "justice infrastructure"--the courts, the sheriff's office, the county commission--is hopelessly corrupt. Have things improved here on the racial front since 1965? I have little doubt that the answer is yes. But can citizens of any color--especially those who somehow are seen as different, or outside the suburban, conservative mainstream--expect to have their legal rights protected? The answer is a resounding no. 

I know that with certainty because of first-hand experience, which I have written about extensively on this blog. I also know from reporting on the legal nightmares of others who have been railroaded in the Shelby County "justice system."

13 years in prison for writing anti banking slogans on sidewalk WITH CHALK!

Jeff Olson, the 40-year-old man who is being prosecuted for scrawling anti-megabank messages on sidewalks in water-soluble chalk last year now faces a 13-year jail sentence. A judge has barred his attorney from mentioning freedom of speech during trial.
According to the San Diego Reader, which reported on Tuesday that a judge had opted to prevent Olson’s attorney from "mentioning the First Amendment, free speech, free expression, public forum, expressive conduct, or political speech during the trial,” Olson must now stand trial for on 13 counts of vandalism.
In addition to possibly spending years in jail, Olson will also be held liable for fines of up to $13,000 over the anti-big-bank slogans that were left using washable children's chalk on a sidewalk outside of three San Diego, California branches of Bank of America, the massive conglomerate that received $45 billion in interest-free loans from the US government in 2008-2009 in a bid to keep it solvent after bad bets went south.

Letter to Justice Thomas from a black woman: re Voting Rights and his vote

Racism is felt daily by those who are non-white.  The Supreme Court (and Thomas's vote on Voting Rights effectively allows people to be prevented from voting - with the Supreme Court's approval.)

It appalls me that you, a black man raised in Jim Crow's South, could rule parts of the Voting Rights Act unconstitutional. De-legitimizing Section 4 of the VRA dismantles the entire legislation. That gives policymakers and the Justice Department no legal authority to enforce Section 5, the core of the document.
In our America, a (black) cashier at McDonald's cannot also be a Princeton undergraduate. I am instead the welfare queen; you are the dope boy. I'm the baby momma; you're the thug. Republicans WAR ON WOMEN - they are blowing it big time.

I'm not going to argue that it is helpful to the Republican cause to have some of their male officeholders talking about masturbating fetuses or the sanctity of rape babies or saying that rape kits are a form of abortion. Your average woman is horrified when they hear Republican men say that wanting access to contraception makes you a slut or that it's almost impossible to get pregnant while being raped. But I don't know that this is really the biggest problem the Republicans have with women right now.

Tammy Duckworth shames businessman for fake VA benefits he gets

Speaking during a hearing of the House Oversight and Government Reform Committee, Duckworth vividly described to a committee witness, Braulio Castillo, how she lives in near constant pain after losing both of her legs during her service as a combat pilot.

Zimmerman case update: Trevon Martin is dead, who is telling the truth?

While some might feel that “Diamond” was a poor witness and lacked credibility, I reached the opposite conclusion. I did not have the impression that Diamond was smart enough to fabricate something that might serve her interest in convicting Zimmerman. To the contrary, it was clear that her motivation was NOT to testify, and she would have obviously preferred to avoid testifying in this matter. Because she reported language used by Martin, including “Nigger” and “creepy-ass cracker” it was clear that she was not trying to report only things that would put Trayvon in the best light possible. There was nothing about her testimony that was contradicted by the physical evidence found at the scene, or by any witness. It was precisely because she was so bold and transparent about her feelings and thoughts that I found her testimony to be believable.

I'll cut straight to the chase and tell you that SB5, the draconian Texas abortion bill that would have closed all but 5 abortion clinics in Texas is dead -- at least for now, though it will be a zombie that rises up if Gov. Rick Perry calls yet another special session.

About 11 hours into Davis' 13-hour filibuster, Texas Republicans, aided by Lt. Gov. Dewhurst, suspended all belief along with the usual order of the Senate and tried very, very hard to end the filibuster by accusing Davis of bogus violations of the filibuster rule. Under the fiibuster rules, Davis was required to remain on the topic of the bill. When she began to discuss forced ultrasound tests for women seeking abortions, the Republicans ruled it was not germane to the bill, which would have been her third violation and would have led to a vote to end the filibuster.
Democrats began raising points of order, objections, and making motions. Without jumping deep into the weeds here, let's just say they were successfully able to continue the delays until about 10 minutes before midnight.

Zimmerman trial: An analysis of the case

Having heard opening arguments yesterday, there is one piece of evidence that the state referenced in opening argument that has not been discussed in articles written about the case thus far.  The state’s attorney mentioned that there had been a woman George Zimmerman had invited to speak to his neighborhood patrol group who would testify about the duties and responsibilities of a neighborhood watch person.  We can presume that such a person will testify that she advised George Zimmerman and the group about the danger to themselves and to innocent people of a neighborhood watch person engaging a suspect, or carrying a weapon.

Climate Change is real! Rick Perry renews a declaration of drought

“Record high temperatures, preceded by significantly low rainfall, have resulted in declining reservoir and aquifer levels, threatening water supplies and delivery systems in many parts of the state,” the proclamation states. “Prolonged dry conditions continue to increase the threat of wildfire across many portions of the state; and… these drought conditions have reached historic levels and continue to pose an imminent threat to public health, property and the economy.”

Spill, Baby Spill! Another toxic oil spill

A huge toxic spill in Alberta, Canada, is raising more questions about the safety of the proposed Keystone XL pipeline, as well as the safety of Canada’s own pipeline network. The company responsible for the spill, Apache Corp., a Texas-based company, kept its size quiet for 12 days after the spill was first discovered. The Dene Tha First Nation tribe, which is dependent on much of the land that’s been destroyed in the spill, is understandably livid about the entire situation. According to ThinkProgress, they said every tree and plant in the spill area died.
Over the past 37 years, Canada has seen an average of two spills per day. Not per week, or per month, or per year… per day. Thus, this particular spill is not an isolated incident. Furthermore, the size of the spill isn’t exactly isolated either. Though the rate of “incidents,” as Alberta’s provincial government calls them, has been declining over the past decade, the fact is they’re still quite common.

Floated about 18 miles on the Cowlitz River Saturday

Gar and I floated the Cowlitz River on a super sunny day.  We were the only people on the River which made it great.  We saw a newborn elk, a deer swam across the river right in front of us.  An eagle spent 10 minutes doing multiple dives trying to eat some baby ducks.  I look like a lobster from the sun and I even put on sun screen.

It was a great day.  It has been awhile.  My body is sore today though, we did a lot of paddling.

Many Conservatives are actually Liberal: New Polling of beliefs

Many of those who viewed themselves as extremely liberal were more moderately liberal. But more extreme, those who called themselves conservatives were often times either solidly moderate, or liberal, in their outlooks. As reported in PsyPost, the youth are ever increasingly more liberal in their viewpoints, while still claiming the mantle of Conservative.
What this means for the Republican party, with its claims of conservatism, is that their days are numbered. While it may claim to be conservative, the truth is liberalism is taking over. It may even be true that conservatism never took hold at all, and that it was only the label, divorced from true conservatism, which was the fad. Ultimately, the fate is clear. Conservatism, as a political force, is dead.

Louisiana has a gas line break - 3rd in a week.

 A natural gas line explosion early Tuesday morning in Louisiana evacuated about 55 people from their homes and closed off roads leading to the area near Enon, outside New Orleans.
WWL TV reports:

The amount of scorched earth near the explosion made it appear as if a bomb was detonated, Seal said.
An approximate 80-foot segment of the pipeline was blown away, causing a nearly 300-foot heavily-wooded radius to be completely leveled, according to Louisiana State Police Trooper Nick Manale.

Tax on Companies that ship jobs overseas- A bill that would have eliminated a tax break that companies get when they ship jobs overseas. Republicans blocked this, allowing companies to keep the tax break they receive when they ship jobs to other countries.

I went camping with 2 daughters, all 5 grandkids and a few others - GREAT WEATHER.

It was a pretty amazing weekend.  We camped in tents, had fires in the morning and nights and enjoyed the sunny weather.  The 9 month old baby grandson even got to camp for the first time.  It was a wonderful way to spend a weekend.  Last week it rained so we were a bit concerned about the weather but it all turned out great.

Immigration Reform and Republicans don't want to block it.

Colorado Fires burns 360 homes - CLIMATE CHANGE IS REAL!! Our new reality.

 A voracious wildfire driven in all directions by shifting winds destroyed at least 360 homes — a number that was likely to climb as the most destructive blaze in Colorado history burned out of control for a third day through miles of tinder-dry woods.
The destruction northeast of Colorado Springs on Thursday surpassed last June's Waldo Canyon fire, which burned 347 homes, killed two people and caused $353 million in insurance claims just 15 miles to the southwest. The heavy losses were blamed in part on explosive population growth in areas with historically high fire risk.

GMO CROPS MAKE SICK PIGS! I want to know if GMO crops are being fed to the animals I eat!

Australian scientists, working with an Iowa farmer and U.S. veterinarians, studied 168 “commercial” piglets as they were raised and fattened for slaughter. Half of the pigs received non-GMO feed and another half ate feed made from GMO corn and soy. Researchers made sure that the GMO feed contained multiple kinds of genetically modified grains that are common in livestock feed; one grain was raised from seed that is herbicide-tolerant, for example, and another from seed that expresses its own pesticide. (One of the complaints of past GMO feeding trials is that they did not reflect actual feeding practices and thus couldn’t account for any potential “synergy” from exposing animals to more than one of these so-called “transgenes.”)

But those pigs that ate the GM diet had a higher rate of severe stomach inflammation — 32 percent of GM-fed pigs compared to 12 percent of non-GM-fed pigs. The inflammation was worse in GM-fed males compared to non-GM fed males by a factor of 4.0, and GM-fed females compared to non-GM-fed females by a factor of 2.2. As well, GM-fed pigs had uteri that were 25 percent heavier than non-GM fed pigs, the study said.

CHEMICAL PLANT EXPLOSION: One Killed, MANY BURNED and injured.

A morning explosion and fire at a Louisiana chemical plant Thursday killed one person and injured dozens more, Gov. Bobby Jindal said.

The explosion took place at Williams Chemical Plant in Ascension Parish, Louisiana State Police said, and a fire after the explosion was contained and extinguished later in the day.
Seventy-three people were taken to local hospitals, and a total of 300 workers evacuated, Jindal said. He said 10 people remained in a safe room at the plant.

Joe Biden takes on Republicans Cruz and Paul

We now have a Congress that is good at DOING NOTHING and Cruz and Paul along with other new Teaparty members of Congress are the reason.  I am glad Biden called them out.

Biden said the "last thing" the country needs is a new senator who will back Cruz and Paul. 

“Think about this,” he said. “Have you ever seen a time when two freshman senators are able to cower the bulk of the Republican Party in the Senate? That is not hyperbole.” 

The vice president pointed specifically to the Senate's rejection of expanded background checks earlier this year. Biden said he reached out to 17 senators, including nine Republicans, ahead of the vote to urge them to support the measure. 

"Not one of offered an explanation on the merits of why they couldn’t vote for the background check," Biden said. "But almost to a person, they said, ‘I don’t want to take on Ted Cruz. I don’t want to take on Rand Paul. They’ll be in my district.’"

7,  Exploiting sick people. The  Christian Post reports that Christine Daniel, a former doctor and ordained Pentecostal minister, was sentenced to 14 years in prison and told to pay over $1.2 million in damages to people she conned into believing that her herbal supplements would cure them of cancer. Daniel hawked her fake cancer cure on Trinity Broadcasting Network’s “Praise the Lord” program, and was found to have done things like telling a patient who still had full-blown breast cancer that she was cured. Authorities claim that at least one patient of Daniel’s would have lived if she had gotten proper medical treatment instead of relying on Daniel’s snake oil.

Greenwald fires back at Republican King who said Greenwald should be arrested.

This Wednesday on CNN's Anderson Cooper 360, the Guardian's Glenn Greenwald was given a chance to respond to Rep. Peter King's calls for the criminal prosecution of those who report on classified information on that same show the prior evening.

Apparently King showed up on Fox the following day as well and told host Megyn Kelly that he didn't want them to go after just any journalists, but that he specifically wanted Greenwald and the Washington Post's Barton Gellman, who also wrote about the NSA, to be prosecuted for publishing the leaks. Lord knows he's not going to tell Megyn Kelly he thinks they should go after anyone at Fox for leaks on our contacts inside North Korea.

I had a 15 year old student (girl) that got impregnated by her step dad and a few friends joined in on sharing her as well.  (Whoever won the poker game during the summer, got to sleep with her.)  She had an abortion and moved away into a Foster home.  Abortion needs to be available and safe.  That decision should be between the woman (girl) and her doctor, not the government.

CONGRESS IS SHUTTING DOWN THE GOVERNMENT

Conservative Republicans in our nation's capital have managed to accomplish something they only dreamed of when Tea Partiers streamed into Congress at the start of 2011: They've basically shut Congress down. Their refusal to compromise is working just as they hoped: No jobs agenda. No budget. No grand bargain on the deficit. No background checks on guns. Nothing on climate change. No tax reform. No hike in the minimum wage. Nothing so far on immigration reform.
It's as if an entire branch of the federal government—the branch that's supposed to deal directly with the nation's problems, not just execute the law or interpret the law but make the law—has gone out of business, leaving behind only a so-called "sequester" that's cutting deeper and deeper into education, infrastructure, programs for the nation's poor, and national defense.

There was another mass shooting here in California last Friday, right in Santa Monica close to where good friends live. It's also close to where Lawrence O'Donnell lives. Did you hear about it?
It didn't seem to splash onto the national radar the way one might expect, given that the deranged young man armed with 1300 rounds of ammunition, an assault-style rifle, and other weapons went to a community college instead of an elementary school. After reporting on Newtown, I guess the national media decided they'd had enough, even though the shooting happened within a few miles of a fundraiser with President Obama in attendance.
