e Supreme Court’s striking down of a highly restrictive anti-choice law on Monday set off some conservatives who had been hoping for a 4-4 tie which would have let the law stand.
By a 5-3 vote, the court threw out a Texas law requiring abortion providers to have admitting privileges at local hospitals with a mandate that clinics must also meet the same strict standards as ambulatory surgical centers.
According to the majority decision, the law went against the undue burden standard established in the 1992 case Planned Parenthood v. Casey.
With Justice Anthony Kennedy’s vote once again being pivotal, the moderate jurist who often seems to be in the middle of every tight decision took more than his share of abuse, with one conservative commentator saying he sided “with the butchers against innocent life.”
