The judge screwed up in the Zimmerman Case. (instructions to Jury the were terrible,)
The prosecution approached the case as a Murder in the 2nd case. This charge satisfied those in the public who were outraged by the notion that a young black teen was profiled. It was anticipated that the “Stand your ground” law would be asserted by Zimmerman. However Mark O’Mara surprised everyone by relying on a simple self defense argument. Having studied the Stand Your Ground Law, his decision to abandon that defense was strategic. Stand Your Ground is not a defense available if the Defendant was determined to be the aggressor. Because Zimmerman got out of the car and followed Trayvon Martin he was clearly the aggressor, at least initially. Instead O’Mara relied on simple self defense.
The jury wasn’t asked if it was wrong for Zimmerman to follow Martin, or to shoot him. They were asked if there was any “reasonable doubt” that Zimmerman acted in self defense.
